Terms of Service
Last updated: [July 2026]
Overview
Welcome to Pawé Lab. In these Terms of Service, “Pawé Lab”, “we”, “us” and “our” refer to PAWE LAB PTY LTD, ABN 83696063573.
We operate this website and online store, including the information, content, features, tools, products and related services made available through it (collectively, the “Services”). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service, together with the policies referred to in them, explain your rights and responsibilities when you access or use the Services.
By accessing or using the Services or placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, please do not use the Services.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.
Section 1 — Eligibility and accounts
You must be at least 18 years old, or otherwise have the legal capacity to enter into a binding agreement, to create an account or place an order.
When using the Services, you agree to provide information that is accurate, current and complete. You must have the right to provide any information submitted on behalf of another person.
You are responsible for keeping your account credentials secure and for activity undertaken through your account, except to the extent that activity results from our act, omission or failure to use reasonable care.
Please notify us promptly if you believe your account has been accessed without authorisation. You must not sell, transfer or provide your account to another person without our written permission.
Section 2 — Products and product information
We take reasonable care to describe and display our products accurately. Colours and appearance may vary slightly depending on your device, screen settings, lighting and photography.
Measurements, weights and other product information may include reasonable variations. Please refer to the relevant product description and Size Guide before purchasing.
We may update product descriptions or discontinue products at any time. These changes will not affect orders we have already accepted unless we contact you and agree otherwise.
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits your rights where a product is faulty, unsafe, not of acceptable quality, does not match its description or is not fit for a disclosed purpose.
Section 3 — Orders
Submitting an order is an offer to purchase the selected products. An order is accepted when we send you an order confirmation confirming acceptance or dispatch the products, whichever occurs first.
We may decline or cancel an order before acceptance where reasonably necessary, including because:
-
A product is unavailable
-
Payment cannot be authorised
-
Order information appears incorrect or incomplete
-
We reasonably suspect fraud, unlawful activity or unauthorised resale
-
A genuine and obvious pricing or product-description error has occurred
-
We cannot deliver to the supplied address
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled portion using the original payment method.
Please review your order carefully before submitting it. We will try to accommodate cancellation or amendment requests, but we may be unable to do so once an order has been processed or dispatched.
Our Refund and Return Policy applies in addition to, and does not replace, your rights under the Australian Consumer Law.
Unless we agree otherwise in writing, products purchased through our retail store are intended for personal or household use and not for commercial resale.
Section 4 — Prices and payment
Unless stated otherwise:
-
Prices are displayed in Australian dollars
-
Prices include GST where GST applies
-
Delivery charges are calculated and displayed before checkout
-
International duties, taxes or import charges may be payable by the recipient where disclosed during the purchasing process or required by the destination country
We may change prices, discounts and promotions at any time before an order is accepted. Changes will not affect an order that has already been accepted.
If more than one price is displayed for the same product, we will comply with applicable Australian pricing laws.
You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the selected payment method.
Promotions may be governed by separate terms. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion, subject always to applicable law.
Section 5 — Shipping and delivery
Delivery timeframes are estimates unless we expressly state that a delivery date is guaranteed. We will take reasonable steps to dispatch and deliver orders within the stated timeframe.
Delays may occur because of carrier disruptions, severe weather, customs processing, incorrect address details or events outside our reasonable control. If there is a significant delay, or we cannot supply your order within the agreed timeframe or a reasonable time, please contact us so we can provide an appropriate solution.
Risk in the products passes to you when the products are delivered to you, your nominated recipient, or a safe location that you authorised. This does not limit any rights you may have if an order is lost, damaged or incorrectly delivered.
You are responsible for providing a complete and accurate delivery address. Additional delivery costs caused by incorrect information may be charged where reasonable and permitted by law.
Please see our Shipping Policy for further information.
Section 6 — Intellectual property
Unless otherwise stated, the Services and their content—including our text, photographs, graphics, videos, product designs, branding, logos and website layout—are owned by or licensed to Pawé Lab and are protected by Australian and international intellectual-property laws.
We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for lawful personal and non-commercial purposes.
Without our written permission, you must not reproduce, modify, distribute, republish, commercially exploit or create derivative works from our content, except where permitted by law.
“Pawé Lab” and our associated names, logos and designs are our trademarks or are used by us under licence. Shopify’s names and marks belong to Shopify or its licensors.
Section 7 — Optional third-party tools
We may provide access to tools or features operated by third parties. Those tools may be subject to the third party’s own terms and privacy practices.
To the extent permitted by law, we do not control and are not responsible for third-party tools. Before using one, you should review the terms that apply to it.
Nothing in this section excludes any responsibility we have under applicable law.
Section 8 — Third-party links
The Services may contain links to third-party websites. A link does not necessarily mean that we endorse or control the third party or its content.
We are not responsible for third-party websites, products or services except to the extent responsibility cannot lawfully be excluded. Please review the relevant third party’s terms and privacy policy before transacting with it.
Questions concerning a third party’s products or services should ordinarily be directed to that third party.
Section 9 — Relationship with Shopify
Pawé Lab’s online store is hosted by Shopify. Purchases made through our store are transactions between you and Pawé Lab, not Shopify.
Shopify is not the seller of Pawé Lab products and is not responsible for fulfilling our obligations to you. Nothing in this section excludes any rights or remedies that cannot be excluded under applicable law.
Section 10 — Privacy
We handle personal information in accordance with our Privacy Policy and applicable privacy laws.
Shopify and other service providers may collect, store or process personal information to host the store, process transactions, deliver orders, prevent fraud, provide support and improve the Services.
Some service providers may process information outside Australia. Our Privacy Policy explains the kinds of information we collect, how it is used and disclosed, how to request access or correction, how to make a privacy complaint, and any likely overseas disclosures.
Shopify’s privacy information is available through Shopify’s Privacy Policy.
Section 11 — Reviews and feedback
If you submit a review, photograph, suggestion or other content (“Feedback”), you grant Pawé Lab a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt and display that Feedback for operating, improving and promoting the Services.
This licence continues for as long as reasonably necessary for those purposes. To the extent permitted by law, you consent to us editing, formatting or reproducing the Feedback and to us not identifying you as its author, unless we agree otherwise.
You confirm that:
-
You created the Feedback or have permission to submit it
-
The Feedback is accurate and not misleading
-
You have disclosed any payment, gift or incentive connected with it
-
It does not infringe another person’s rights or breach any law
We may moderate or remove Feedback where we reasonably believe it is unlawful, misleading, offensive, defamatory, infringing or otherwise breaches these Terms. We are not required to publish submitted Feedback.
Section 12 — Errors and availability
We may correct typographical errors, inaccurate product information or omissions on the Services.
If an error affects an order you have submitted, we will contact you as soon as reasonably practicable. Where the order has not been accepted, we may give you the option to proceed using the corrected information or cancel the affected item.
Where we cannot fulfil an accepted order, we will provide an appropriate solution, which may include a replacement, alternative product or refund, subject to your rights under the Australian Consumer Law.
Section 13 — Acceptable use
You must not use the Services:
-
For an unlawful, fraudulent or malicious purpose
-
To infringe another person’s intellectual-property, privacy or other legal rights
-
To harass, threaten, abuse, defame or harm another person
-
To submit false, misleading or deceptive information
-
To distribute spam, malware, malicious code or unauthorised advertising
-
To impersonate another person or misrepresent your identity
-
To interfere with the security, operation or availability of the Services
-
To collect personal information without authority
-
To bypass access restrictions or security controls
-
To scrape or extract content or data for commercial purposes without permission
We may restrict access where we reasonably believe these requirements have been breached.
Section 14 — Automated systems and agents
Automated systems, bots and artificial-intelligence agents must not access or interact with the Services in a way that:
-
Breaches applicable law or these Terms
-
Conceals or misrepresents that the interaction is automated
-
Bypasses CAPTCHAs, access controls or security measures
-
Unreasonably disrupts or burdens the Services
-
Scrapes protected content or personal information without permission
We may use reasonable technical measures to manage automated access. This section does not prohibit ordinary assistive technologies, generally available search-engine indexing that follows our published instructions, or conduct that cannot lawfully be restricted.
Section 15 — Suspension and termination
You may stop using the Services at any time.
We may suspend or terminate access where reasonably necessary, including where we reasonably believe that you have materially breached these Terms, acted unlawfully, threatened the security of the Services or failed to pay an amount properly due.
Where practicable, we will provide reasonable notice and an opportunity to address the issue. Immediate action may be taken where necessary to protect customers, Pawé Lab, Shopify or other parties from fraud, harm, security threats or unlawful conduct.
Termination does not affect rights or liabilities that arose before termination. If we cancel an accepted and paid order without supplying the product, we will provide a refund unless another remedy is agreed or permitted by law.
Section 16 — Consumer guarantees and warranties
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For goods, these guarantees may include that they are of acceptable quality, match their description, are fit for any disclosed purpose and correspond with any sample or demonstration model.
Where there is a major failure, you may be entitled to reject the goods and choose a refund or replacement, or seek compensation for the reduction in value. For a non-major failure, we may be entitled to provide a remedy within a reasonable time.
You may also be entitled to compensation for reasonably foreseeable loss or damage resulting from a failure to comply with a consumer guarantee.
Any voluntary warranty or change-of-mind policy we offer operates in addition to these rights.
Section 17 — Liability
Nothing in these Terms excludes, restricts or modifies:
-
Your rights under the Australian Consumer Law
-
Liability for fraud or fraudulent misrepresentation
-
Liability for death or personal injury caused by negligence
-
Any other right or liability that cannot lawfully be excluded, restricted or modified
Subject to the above and to the maximum extent permitted by law, neither party will be liable to the other for indirect or consequential loss that was not reasonably foreseeable when the relevant agreement was made.
You are responsible for following product instructions, warnings and sizing guidance. This does not reduce our responsibility for a defective or unsafe product or otherwise limit your statutory rights.
Section 18 — Indemnity
To the extent permitted by law, you are responsible for reasonable loss suffered by Pawé Lab as a direct result of your unlawful use of the Services or your material breach of these Terms.
You will not be responsible to the extent that the loss was caused or contributed to by Pawé Lab, Shopify or another person for whom we are legally responsible.
Nothing in this section requires you to indemnify us for liability that cannot lawfully be transferred to you.
Section 19 — Complaints and dispute resolution
If you have a concern, please contact us first at hello@pawelab.com and provide your name, order number and a description of the issue. We will try to investigate and respond within a reasonable time.
If we cannot resolve the matter, you may contact the consumer-affairs or fair-trading body in your Australian state or territory. You may also have the right to pursue the matter through a court or tribunal.
Nothing in this section prevents either party from exercising a legal right or seeking urgent relief.
Section 20 — Severability
If a provision of these Terms is found to be unlawful, void or unenforceable, it will be read down to the minimum extent necessary to make it valid where possible.
If it cannot be read down, the affected portion will be severed. The remaining provisions will continue to operate.
Section 21 — Waiver and entire agreement
A failure or delay in exercising a right under these Terms does not waive that right.
These Terms and the policies incorporated by reference form the agreement between you and Pawé Lab concerning the Services, subject to any additional terms expressly agreed with you and any rights that apply under law.
Nothing in this section excludes representations or rights that cannot lawfully be excluded.
Section 22 — Assignment
You must not assign your rights or obligations under these Terms without our written consent, which will not be unreasonably withheld.
We may assign our rights and obligations as part of a genuine sale, transfer or restructuring of our business, provided this does not materially reduce your rights. We will give notice where reasonably practicable or required by law.
Section 23 — Governing law
These Terms are governed by the laws of [INSERT AUSTRALIAN STATE OR TERRITORY—FOR EXAMPLE, VICTORIA] and the Commonwealth of Australia.
You and Pawé Lab submit to the non-exclusive jurisdiction of the courts and tribunals of that state or territory and any courts entitled to hear appeals from them.
Nothing in this section prevents you from exercising rights available under the law of the state or territory in which you live.
Section 24 — Changes to these Terms
We may update these Terms to reflect changes to our Services, business practices or legal obligations.
Changes apply from the effective date shown in the updated Terms and ordinarily apply prospectively. They will not retrospectively alter an order already accepted unless required by law or agreed with you.
Where a change materially affects customers’ rights or obligations, we will provide reasonable notice where required by law. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms for future use of the Services.
